How directors protect themselves in the current environment

How directors protect themselves in the current environment

A balancing act: how directors can best protect themselves in the current environment

Overview

Directors and senior management take on significant personal risk and responsibility in their professional roles. In the current environment this risk is even more acute given the growth in chain of responsibility legislation, emerging obligations such as cyber risk and the growing pressure on organisations to reduce insurance programs.

Join senior leaders in the risk and D&O insurance space to help gain an understanding of the key methods that are available to protect them and offset personal exposures. In this session they will:

  • analyse the key protections that directors often rely on through deed of indemnity, deeds of access, insurance programs and claims management;
  • explore potential tensions which can arise between directors and companies in relation to indemnity for personal liability, and how these can be effectively navigated;
  • examine specific strategies directors can adopt to obtain confidence in their company’s insurance program design and strategy, and analyse key exclusions contained within D&O insurance programs and how the impact of these exclusions can be minimised; and
  • analyse the key regulatory and legal risks being seen for directors in the current environment, and provide practical guidance on lessons which can be learned from recent claims and events.
